What is a permanent establishment

According to German tax law, permanent establishment refers to any fixed business facility or facility that serves the activity of a company. This includes in particular the location of the management, branches, offices, manufacturing and workshops, warehouses, buying and selling points, mines, quarries and other sites for the extraction of natural resources. Construction work and assembly work are also included if they take longer than six months.
Im Rahmen der internationalen Tax planning spielt häufig die Frage eine Rolle, ob ein Unternehmen im Ausland eine Betriebsstätte oder eine rechtlich selbständige subsidiary gründen soll. Eine allgemeingültige Antwort auf diese Frage gibt es nicht. Vielmehr kommt es jeweils auf die Situation im Einzelfall an. Auf keinen Fall sollte die Entscheidung aber allein aus steuerlicher Sicht getroffen werden.
