Individual labor law

Individual labor law regulates the individual relationships between employees and employers. It is applied to the employment relationship, in the context of which one undertakes to make his labor available to an employer in return for payment, subject to instructions.
Two areas of individual labor law can be distinguished:

Employment contract law

Das Arbeitsvertragsrecht, das die Rechte und Pflichten der Parteien von Arbeitsverträgen regelt. Voraussetzung für einen wirksamen Arbeitsvertrag ist u.a. nach §§ 104 ff. BGB die Geschäftsfähigkeit von Arbeitgeber und Arbeitnehmer. Als Rechtsquellen gelten:

Civil Code (BGB): It contains basic provisions of the service contract in §§611-630 BGB. In addition, the provisions of the general part of the BGB (first book) and the general part of the law of obligations (§§ 241 to 432 BGB) apply.

Commercial Code (HGB): In §§ 59 ff. HGB it contains regulations for employees who are employed to perform commercial services, e.g. B. Clerks and trainees.
- Industrial Code (GewO): It contains special regulations for industrial workers (e.g. journeymen, assistants) (§ 105 ff. GewO). Sections 133c to 133f GewO apply to commercial employees.

Vocational Training Act (BBiG): It contains regulations on the contracts of the people employed for their vocational training, e. B. According to § 4 BBiG, the written form is required for apprenticeship contracts.

Employee protection law

Das Arbeitnehmerschutzrecht, das z. B. den Arbeitszeitschutz, den Arbeitsplatzschutz, die Urlaubsgewährung, die Lohnsicherung, den Kündigungsschutz, den Maternity Protection, den Jugendarbeitsschutz und den Sonderschutz für Schwerbehinderte umfasst.
